Agreement to Terms

By downloading, installing, or using Avocall, you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not use our service.

Description of Service

Avocall provides affordable international calling services over the internet (VoIP). The service requires an internet connection (WiFi or mobile data) to function. Call quality depends on your internet connection.

Personal Use Only

Avocall is an international calling service intended exclusively for personal, non-commercial communication between individuals. By using Avocall, you agree that:

  • You will use the service only for personal, non-commercial communication
  • You will not use Avocall for any business, commercial, organizational, or promotional purposes
  • You will not use Avocall on behalf of any business, organization, or other entity
  • You will not use Avocall for robocalling, automated dialing, telemarketing, or any automated communications
  • Your calling activity will be conversational in nature, consistent with personal use
  • You are limited to one account per person; creating multiple accounts is prohibited

Acceptable Use

You agree not to use the service for:

Calling Restrictions

  • Robocalling, auto-dialing, or placing automated calls of any kind
  • Commercial telemarketing, sales calls, or promotional calls
  • Use of scripts, bots, or any automated systems to initiate or manage calls
  • Placing calls on behalf of a business, organization, or third party
  • Call flooding, spamming, or placing excessive numbers of short-duration calls
  • Using the service for call center operations or high-volume outbound calling
  • Spam calling, unsolicited marketing calls, or bulk calling campaigns

Prohibited Uses

  • Harassment, threats, abuse, or intimidation via calls
  • Debt collection or loan solicitation
  • Get-rich-quick schemes or financial fraud
  • Phishing, social engineering, or identity theft
  • Any activity that violates applicable laws or regulations

Other Prohibited Uses

  • Illegal activities or fraud
  • Impersonation or misrepresentation
  • Commercial or business purposes
  • Any activity that violates applicable laws

Fair Use Limits

To maintain service quality and comply with carrier and VoIP provider policies, Avocall may limit the number or duration of calls you can place per day. Exceeding reasonable personal use patterns may result in temporary restrictions or account suspension. Personal use typically involves conversational, two-way communication between individuals rather than high-volume or automated calling.

Carrier and VoIP Compliance

Avocall provides international calling services through telecommunications carriers and VoIP providers that operate under strict industry regulations. You agree to:

  • Comply with all applicable carrier and VoIP provider policies
  • Accept that carrier policies may be more restrictive than these Terms and will take precedence
  • Acknowledge that carriers may block or restrict calls that violate their policies
  • Understand that violations may result in call blocking, account suspension, or permanent termination

Avocall reserves the right to modify calling capabilities or impose additional restrictions as required by carriers, VoIP providers, or regulatory bodies.

Monitoring and Enforcement

To protect our users, maintain service quality, and comply with carrier requirements, Avocall may:

  • Use automated systems to monitor calling patterns and detect potential abuse
  • Review call metadata (caller, recipient, timestamp, duration, volume) for compliance
  • Investigate reports of spam calling, harassment, or policy violations
  • Suspend or terminate accounts that violate these terms without prior notice
  • Cooperate with carriers and VoIP providers to identify and address calling abuse
  • Report illegal activity to law enforcement when required by law

We do not record or store the content of your calls. However, we retain call metadata (such as call duration, timestamps, and phone numbers) as necessary for billing, service operation, and compliance. We may share call metadata when investigating reported violations or when required by law.

Account and Caller ID

Avocall uses your account information and internet connection to route international calls. Call quality, availability, and supported destinations may vary depending on your plan, network conditions, and carrier routing. We reserve the right to modify supported calling destinations at any time.

Emergency Services

IMPORTANT: Avocall is not a replacement for traditional phone service. Emergency calling (911) may not function correctly or at all through Avocall. Do not rely on Avocall for emergency communications. Always have an alternative means to contact emergency services.

Premium Subscription

Premium subscriptions are billed through the App Store (iOS) or Google Play (Android). Subscription prices may vary by region. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.

You can manage or cancel your subscription through your device's app store settings. Refunds are handled according to Apple's or Google's policies.

Account Termination

We reserve the right to suspend or terminate your account at our discretion if you violate these terms, engage in abusive behavior, or use the service in ways that harm other users or our infrastructure.

Your account may be terminated immediately and without notice if:

  • Your calling patterns indicate non-personal or commercial use
  • You exceed reasonable personal use fair use limits
  • Carriers flag your account for spam calling, fraud, or policy violations
  • You engage in robocalling, telemarketing, or automated dialing
  • You use automation, bots, or scripts to place calls
  • We receive valid legal requests requiring account termination

You will not be entitled to any refund for unused premium subscription time or remaining call credits if terminated for policy violations.

Disclaimer of Warranties

Avocall is provided "as is" without warranties of any kind. We do not guarantee uninterrupted service, perfect call quality, or call connectivity to all destinations. Service may be affected by network conditions, device compatibility, or other factors beyond our control.

Limitation of Liability

To the maximum extent permitted by law, Avocall shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the service, including but not limited to loss of data, missed calls, or service interruptions.

Changes to Terms

We may modify these Terms of Service at any time. We will provide notice of significant changes through the app or by email. Your continued use of Avocall after changes constitutes acceptance of the new terms.

Governing Law

These terms are governed by the laws of the State of California, United States, without regard to conflict of law provisions.
